Violência por menores infratores

Escrevi um pequeno desabafo na minha conta pessoal do Facebook, que reproduzo aqui, sobre a crise na segurança do Rio de Janeiro e menores infratores. Segue o texto:

Imaginando que exista alguma inteligência policial no Rio de Janeiro, temos a impressão de que não é melhor do que a dessa charge da New Yorker.

Hoje eu soube que na esquina da Rua Uruguai com a Conde de Bonfim, onde uma pastelaria chinesa mantém por perto e bem alimentados dois policiais em um carro de patrulha, ocorrem roubos diários praticados por adolescentes vestidos com uniformes de escola pública. Por volta de 9:30 da manhã o bando de estudantes passa na esquina e faz vítima alguma mulher ou idoso, todo dia. Segundo relato de pessoas que trabalham no local, a polícia foi orientada a não fazer nada, pois, como é para soltar, é melhor não ter o trabalho de prender.

Outro dia, no Centro do Rio, uma colega advogada teve o cordão roubado. Nada demais, só rotina. Mas ocorreu ao lado de um policial! Que nada fez.

Eu mesmo já vi vários desses atos violentos acontecendo no Centro do Rio, e, por acaso, todos foram praticados por crianças e adolescentes. A polícia raramente faz alguma coisa. Eu queria ver um policial fazer o que os pais que eu conheço fariam com seus filhos se os pegassem roubando. Eu imagino que pais amorosos fariam exatamente o que está no ECA (Estatuto da Criança e do Adolescente). Duvido que algum pai ou mãe colocaria seu filho adolescente em uma prisão comum para ser violentado por outros bandidos.

Antes de tudo, pais amorosos fariam o filho devolver o que foi roubado (art. 116 do ECA), com um bom pedido de desculpas à vítima. Depois teriam uma boa conversa, com todas as advertências necessárias (art. 115 do ECA) e submeteriam o filho a um castigo pedagógico, com realização de tarefas gratuitas de interesse geral, por até 6 meses (art. 117 do ECA). No mínimo, o menor teria que lavar louça, fazer faxina, lavar e passar roupa, levar o cachorro para passear, recolher as fezes da calçada, e outras tarefas que pessoas que roubam odiariam fazer.

Tudo seria feito sem prejuízo das atividades escolares, que precisam continuar (art. 117 parágrafo único). A liberdade seria assistida, por no mínimo seis meses, envolvendo promoção social do adolescente e de sua família por programa comunitário de auxílio e assistência social, acompanhamento da frequência e aproveitamento escolar, promoção da profissionalização do adolescente com inserção no mercado de trabalho, tudo registrado em relatório a ser entregue ao Poder Público (artigos 118 e 119 do ECA).

Em último caso, o menor pode ser privado de sua liberdade, sendo internado em instituição própria para menores. Hoje já não existem mais escolas em regime de internato, mas antigamente os pais preocupados com a educação e o comportamento dos filhos, matriculavam-nos em internatos, onde aprendiam a ter disciplina, entre outras coisas. O ECA permite que o Poder Público tenha esse tipo de iniciativa (artigos 121 a 125).

Para as crianças que não têm família, ou têm pais que não agem de forma a proteger seus melhores interesses, o ECA prevê a família substituta (artigos 28 a 52-D).

O que houve com o ECA (Lei 8.069 de 1990)? Ele praticamente não existe. Ninguém discute o que está em seus artigos. Preferem discutir se a maioridade penal será aos 18 ou aos 16 anos de idade.

Essa discussão da maioridade penal é a mais inútil que eu já vi. Nada pode melhorar com a alteração da maioridade penal.

O governo federal, por sua vez, precisando cortar despesas, escolhe reduzir o orçamento da saúde, educação, da segurança, mas não prejudica o bolsa família. Ou seja, para os carentes que tanto precisam das medidas protetivas que o ECA “garante” às crianças e adolescentes, o governo acha que deve dar dinheiro. Melhor distribuir dinheiro do que educar. E alguns ainda acham que devem distribuir dinheiro e mandar os pivetes para prisões comuns. Mas no Brasil isso é perfeitamente compreensível: muitos anos de negligência na educação não poderiam resultar em boa inteligência mesmo.

E ainda dizem que o problema é a lei que permite o “prende e solta”. Desculpem os que pensam assim, mas por falta de bons argumentos em contrário, devo insistir: o problema é a falta de conhecimento e de educação mesmo. Aquela velha estória…
